Atlanta Light Bulbs Terms and Conditions
Your use of the Atlanta Light Bulbs.com web site, the Site, is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this Site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. These terms and conditions may be changed without notice by Atlanta Light Bulbs, Inc. in the future. It is your responsibility as a user to periodically return to this page to review the terms and conditions for amendments. The amended terms shall take effect automatically the day they are posted on the site. Your continued use of the Atlanta Light Bulbs web site following any amendments will constitute agreement to such amendments. These Terms of Service were last revised on April 4th 2008.

Substitutions: Atlanta Light bulbs reserves the right at any time to substitute items meeting or exceeding the specifications as listed in the description of the item. Atlanta Light Bulbs may substitute items to avoid lengthy backorders, to replace discontinued items and in an effort to maintain the displayed prices. Atlanta Light Bulbs will substitute items of equivalent function, quality and similarity of use.

Order Changes/Cancellations: Atlanta Light Bulbs does not accept changes in shipping addresses, shipping methods or quantity changes once we have input the order into our system. Once the order has been shipped the order cannot be canceled or changed and the buyer must contact Atlanta Light Bulb at www.atlantalightbulbs.com/returns for an RGA request. DO NOT PHONE IN FOR RGA REQUESTS OR FOR DAMAGES.

Cross Reference Items: The term ‘Cross Reference Item. Equivalent item of alternate brands may be substituted due to stock or item availability’ is used by Atlanta Light Bulb to advise the buyer that they are purchasing an item that is coming from our cross reference database. Atlanta Light Bulbs has amassed a large database of part numbers that are equal in use and functionality. Many items in our Cross Reference database are discontinued, not readily available, or have been upgraded since their production. Atlanta Light Bulbs chooses the brand lamp you, the buyer, will be receiving, we do because of stock availability and pricing levels for certain items, many brands are not available for the displayed cross reference price. Atlanta Light Bulbs will substitute items of equivalent function, quality and similarity of use. Atlanta Light Bulbs has the right to send you (the buyer) the brand that Atlanta Light Bulb has chosen to be the appropriate substitute for the item you, (the buyer) have purchased. If you, the buyer, would like a specified brand it is your responsibility to contact Atlanta Light Bulbs to check which brand you will be receiving, email customer service http://www.atlantalightbulbs.com/contact.html

Delivery: All orders are shipped within 24-48 hours unless the item is not in stock. Please allow a minimum of 4-10 business days for delivery of your order. Atlanta Light Bulbs will notify you of items not in stock within 48 hours of the order being received on our Website and is accepted by an Atlanta Light Bulb employee. Atlanta Light Bulbs can bill your UPS or FEDX account however this must be noted on the order at the time the order is placed or this service is not available to the buyer. Upgraded shipping services, Next Day, 2nd Day, etc., are available at an additional charge. In the event only some of the product is in stock at the time an order is placed, the available product will be shipped via the upgraded service and the backorder will ship via Ground service when stock is replenished. Atlanta Light Bulbs will try to ship your order out on time and within the stated hours above however, Atlanta Light Bulbs is not responsible or liable for any delay in receiving or completing your order that is caused by an event beyond Atlanta Light Bulb's reasonable control.

Mistaken and Damaged Shipments: Atlanta Light Bulbs will refund any shipping charges when Atlanta Light Bulbs is at fault, when not at fault it is they buyers responsibility. Any and all damages incurred in shipping must be reported within 72 hours from the receipt of material. Report damages on our website by using our online form at http://www.atlantalightbulbs.com/returns/ and fill out the information form. If the packing shows obvious signs of damage please note this when signing for the package from the carrier and report this immediately to the carrier at this time, then contact Atlanta Light Bulb via email returns@atlantalightbulbs.com, PLEASE DO NOT REFUSE SHIPMENT.

Products: Atlanta Light Bulbs may discontinue any product at any time without notice. In this instance you, the buyer, will be notified as soon as we are notified by the manufacturer or broker. Atlanta Light Bulbs has the right to cancel the order or to substitute an item of equivalent specifications. The product prices displayed on this Site do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. Atlanta Light Bulbs has the right to mix brands on an item to fill the requirement of the order once accepted.

Pricing: Prices displayed on the Atlanta Light Bulbs web site apply solely to orders placed online. If product price errors are discovered, they are promptly corrected on our systems, and the corrected price will apply. We will notify you if your order includes items that were incorrectly priced. Prices are subject to change without notice and in the event of any price increases the customer will be contacted for approval prior to processing any order. Non Brand Name Products: Items that are not labeled as Major, GE, Sylvania, Osram or Ushio and do not carry the Cross Reference Clause ‘Cross Reference Item. Equivalent item of alternate brands may be substituted due to stock or item availability’ are Off Brand Products, these products meet or exceed the specifications as listed in the description. These items’ manufacturers are commercial and residential lighting manufacturers who lamp names may or may not be recognizable by the general public. Atlanta Light Bulb is the sole decision-maker in what brand we will provide to fill this product requirement. The term ‘Major brand’ where specified generally means the product will be either GE, Philips, OSRAM, Sylvania, or Ushio however it list not limited to these brands only.

Order Acceptance: Atlanta Light Bulbs has the right to accept or reject any order placed over our web site. Orders are not binding upon Atlanta Light Bulbs until accepted by one or more of our representatives. Atlanta Light Bulbs reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order. Any order that exceeds $500 is subject to the processing of a Credit Card Authorization form. This form must be filled out and faxed back to Atlanta Light Bulbs before we will accept your order.

Payment: Major credit cards-American Express, Visa, Master Card and Discover are all accepted. All credit cards are billed once the order has shipped. Any items that are special order or over $500 are subject to prepayment of the full amount due before Atlanta Light Bulbs will release the order or before Atlanta Light Bulbs will order the special order product from the manufacturer. NO COD’S. Atlanta Light Bulbs also accepts commercial and institutional purchase orders. Sales Tax: You are responsible for the payment of any state and local sales or use taxes that may apply to your order. The sales tax is calculated based on the full invoice price, and may include charges for shipping and handling if required by law. We will collect the sales & use tax for the order from the State of Georgia.

Shipping Policy: Atlanta Light Bulbs passes responsibility of delivery to the carrier at the time of pickup at our warehouse. Losses of items during shipment are the responsibility of the carrier. Atlanta Light Bulbs will provide you, the buyer, with a tracking number and a toll free number for the carrier. It is the buyer’s responsibility to contact the carrier and notify them of the loss before the reclaiming process can begin. Our standard method of shipping orders within the continental US is via UPS ground service. Unfortunately from time to time Atlanta Light Bulbs web site miscalculates freight charges on the buyer’s online order. If any additional shipping cost is incurred the customer will be contacted prior to shipment and we will not accept the order until you, the buyer, have agreed to the new shipping charges.

International Shipments: Atlanta Light Bulbs ships to all 48 states within the continental US. All Shipments to Alaska, Hawaii, other US Territories, Canada, and Mexico will be arranged and additional shipping charges will apply. For International orders there is a $500.00 minimum. We only accept Wire Transfers from International customers. We will not ship your order until the monies have been received and verified by Atlanta Light Bulbs accounting office. The International customer must provide Atlanta Light Bulb with a Valid UPS, DHL or FEDX account number as we will not prepay and add shipping charges to International orders. The International customer also has the option to have their shipment sent to a freight forwarder. Additional shipping charges will apply. The customer is responsible for payment of taxes, duties, tariffs and any other charges levied by government agencies. We are not responsible for the product once in the hands of the freight forwarder we have shipped the product to.

Shipping & Handling S&H Charges: Shipping and Handling charges are NON REFUNDABLE to the buyer unless Atlanta Light Bulbs is at fault due to an error in order picking or misshipment.

Warranties: ALL PRODUCTS ARE SOLD ‘AS IS,’ AND CARRY NO WRITTEN WARRANTY BY ATLANTA LIGHT BULBS OR THE LAMP MANUFACTURER.

Return Request: Request for returns must be made within 7 days of noted delivery by the carrier. Merchandise will not be considered for return and credit unless you, the buyer, have prior written approval from Atlanta Light Bulbs. *Merchandise that has been installed or used will not be accepted for return. All freight charges for returned merchandise must be prepaid by the shipper. Merchandise returned to Atlanta Light Bulb without an RGA number will be refused or discarded and no credit issued. To send back a return an RGA number must be referenced on the shipment back to Atlanta Light Bulbs. RGA REQUESTS ARE ONLY ACCEPTED VIA EMAIL. In the event of a need for a return or exchange Atlanta Light Bulbs has the right to levy a restocking fee, deny the return or issue an exchange on a product. *Special order products that are not in stock at time of order are Non Returnable.

Restocking Policy: Atlanta Light Bulbs will charge a Restocking Charge of upto 50% on the value of the product solely. Some items are non returnable and will not be considered for credit or for an RGA number. The amount to be refunded must be credited via the original payment method. You, the buyer, are responsible for all freight charges and this amount will not be credited. This applies to all items returned where Atlanta Light Bulbs is not responsible for the discrepancy.
